These Terms of Service (“Terms”) govern your use of CreatorOS (“Platform”, “we”, “us”, “our”), operated by [Your Full Legal Name / Company Name], [Your Registered Address], India.

By accessing or using CreatorOS, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

“Creator” means any individual or entity that registers on CreatorOS to sell products, courses, or services.

“Buyer” means any individual who purchases a product or course listed on the Platform.

“Content” means any digital product, course, file, text, image, or material uploaded or listed by a Creator.

“Platform Fee” means the fee charged by CreatorOS for providing the service, as described in the Pricing section.

2. Eligibility

You must be at least 18 years of age to use CreatorOS. By using the Platform, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

CreatorOS is intended for use within India. Users outside India may access the Platform but are responsible for compliance with their local laws.

3. Creator Accounts

3.1 Creators are responsible for maintaining the confidentiality of their account credentials. Any activity under your account is your responsibility.

3.2 Creators represent and warrant that:

  • They have full rights to sell all Content listed on the Platform
  • Their Content does not infringe any third-party intellectual property rights
  • Their Content complies with all applicable Indian laws
  • They are responsible for the accuracy of all product descriptions, pricing, and delivery information

3.3 CreatorOS reserves the right to suspend or terminate any Creator account that violates these Terms, without prior notice.

4. Prohibited Content

Creators must not upload, list, or sell:

  • Pornographic, obscene, or sexually explicit material
  • Content that promotes violence, hatred, or discrimination
  • Counterfeit, pirated, or plagiarized material
  • Content that violates any Indian law including the Information Technology Act, 2000
  • Content that is misleading, fraudulent, or deceptive
  • Personal data of third parties without their consent
  • Content regulated by specific licensing requirements (financial advice, medical advice, legal advice) without appropriate disclosures and qualifications

5. Payments and Fees

5.1 All transactions on CreatorOS are processed through third-party payment providers (Stripe and Razorpay). By transacting on the Platform, you also agree to their respective terms of service.

5.2 CreatorOS charges a platform fee on each transaction. Current fees are displayed on the Pricing page and may be updated with 30 days notice.

5.3 Creators are solely responsible for:

  • Determining and collecting applicable GST on their products
  • Filing GST returns if registered under GST
  • Issuing proper tax invoices to buyers where required
  • Compliance with TDS obligations under the Income Tax Act, 1961

5.4 CreatorOS may issue GST invoices for platform fees charged to Creators. These will be available in the dashboard.

5.5 Payouts are processed subject to payment provider timelines. CreatorOS is not liable for delays caused by payment providers or banks.

6. Refund Policy

6.1 Creators set their own refund policies for their products and courses. CreatorOS is not responsible for enforcing or funding Creator refunds.

6.2 CreatorOS platform fees are non-refundable once a transaction has been processed.

6.3 In cases of fraud or technical error causing duplicate charges, buyers may contact CreatorOS support at support@creatoros.in within 7 days of the transaction.

6.4 Under the Consumer Protection Act, 2019, buyers have certain statutory rights. Nothing in these Terms limits those rights.

7. Intellectual Property

7.1 Creators retain full ownership of all Content they upload to the Platform.

7.2 By uploading Content, Creators grant CreatorOS a limited, non-exclusive, royalty-free license to display, reproduce, and distribute their Content solely for the purpose of operating the Platform.

7.3 CreatorOS owns all rights to the Platform itself, including its design, codebase, trademarks, and branding. You may not copy, reproduce, or create derivative works from any part of the Platform.

8. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied.

CreatorOS does not warrant that:

  • The Platform will be uninterrupted or error-free
  • Content sold by Creators meets any particular standard of quality or accuracy
  • The Platform will meet your specific requirements

CreatorOS is a marketplace. We are not a party to transactions between Creators and Buyers, and we do not endorse, guarantee, or take responsibility for any Creator’s products, courses, or services.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, CreatorOS and its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data
  • Disputes between Creators and Buyers
  • Content uploaded by Creators
  • Actions or omissions of third-party payment providers

Our total liability for any claim arising under these Terms shall not exceed the platform fees paid by you in the three months preceding the claim.

10. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of the Grievance Officer are:

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be [Your City], India. The language of arbitration shall be English.

The courts of [Your City], India shall have exclusive jurisdiction for any matters not subject to arbitration.

12. Changes to Terms
